Astanehe Law Prevails in the California Court of Appeal
In Mollica v. IGS Solutions, the California Court of Appeal upheld the trial court’s denial of Defendant’s motion to compel arbitration on the grounds that, under the principle of equitable estoppel, one plaintiff could not be compelled to arbitrate her claims as she never signed an arbitration agreement, and the other could not be compelled to arbitrate her claims as the arbitration agreement – which failed to define her employer – was invalid and unenforceable. The Center for Consumer Law & Economic Justice wrote a letter requesting the court certify the opinion for publication.
