San Mateo County Superior Court Issues Coronavirus/COVID-19 Related Order Regarding Pending Eviction Actions
On Monday, May 18, 2020, the San Mateo County Superior Court issued an order for pending unlawful detainer (eviction) actions in light of the Coronavirus/COVID-19 pandemic. As the San Mateo County Superior Court gradually reopens following a two-month closure in response to the Coronavirus/COVID-19 pandemic, the court orders the following regarding pending eviction actions:
- The San Mateo County Superior Court Order prohibits eviction court judges from entering a default through at least June 12, 2020;
- The San Mateo County Superior Court Order prohibits eviction court judges from issuing writ of possession through at least June 12, 2020;
- The San Mateo County Superior Court Order stays (pauses) the execution of any previously issued writ of possessions through at least June 12, 2020;
- The San Mateo County Superior Court Order designates all dates through May 14, 2020, and June 12, 2020, as holidays for computing time for court filings in pending eviction cases;
- The San Mateo County Superior Court Order prohibits eviction mandatory settlement conferences from being scheduled until on or after June 18, 2020; and,
- The San Mateo County Superior Court Order requires eviction courts to wait until at least June 22, 2020 before scheduling any pending eviction case trials.
The San Mateo County Superior Court may extend the dates specified above, if the Coronavirus/COVID-19 pandemic continues affecting public safety.
