Emeryville tenants who have deferred rent under the Emeryville Coronavirus/COVID-19 Pandemic Eviction Moratorium have at least one year from the end of the Moratorium to pay off deferred rent. In June 2020, the Emeryville City Council adopted an amendment requiring landlords to present a written plan that provides at least twelve months for paying off rent deferred under the Emeryville Coronavirus/COVID-19 Pandemic Eviction Moratorium.
Emeryville tenants must know that the required plan is not a contractual agreement and Emeryville tenants are not required to sign the written plan. Further, Emeryville tenants do not need to sign anything to obtain a full year to pay off rent deferred under the Emeryville Coronavirus/COVID-19 Pandemic Eviction Moratorium.
Emeryville landlords that fail to comply with the requirement to provide Emeryville tenants with a written payment plan may not serve a three-day notice to collect rent deferred under the Emeryville Coronavirus/COVID-19 Pandemic Eviction Moratorium. With this enactment, Emeryville tenants will not face eviction for rent deferred under the Emeryville Coronavirus/COVID-19 Pandemic Eviction Moratorium until the landlord furnishes a written payment plan; and, at least one year-elapses since the end of the local Moratorium.
